AVENUE ANNE TERMS AND CONDITIONS
At Avenue Anne Custom Cards, your satisfaction is our guarantee. If you have any questions about our terms and conditions, please call us at (412) 781-5773 or email: info@avenueanne.com All orders are reviewed by a professional designer, we offer custom options for font, color and layout with electronic proofing for a nominal fee.

CANCELLATIONS
For cancellations and last minute changes, please contact us as soon as possible. Once your order is sent to our print shop - they print! Avenue Anne custom printing orders cannot be cancelled or returned. A $15 Cancellation Fee applies if we receive a request to cancel your order before it is in production.

CUSTOM ORDERS
Our talented design team is happy to help you create a personalized design for your celebration. Our design fee is $125 and includes 3 design options and up to 3 revisions.

CHANGES TO CARD TEMPLATES
Free changes to Avenue Anne Card designs include and are limited to: Insertion of your personal photograph. Changing text with your personal information and greeting. A $15 customization fee applies to the following changes: Text layout Design Layout Background or Graphic Color Font Style.

RESTRICTIONS
Background color changes and custom color changes may not be available for all AVENUE ANNE designs. Due to copyright laws, we cannot add your clipart or fonts to any AVENUE ANNE cards.

PAYMENT
After customization and review of your order, payment will be taken in full at the time you place your order online.

PROOFS
For ease of ordering, request an electronic proof. Please note that due to variations in computer screen resolutions, the colors as you view them at home may vary from the finished product. A proof for each printed piece will be emailed to you from the Paper Source Invitations Department within 4-5 business days of your order being placed. Printed items will be typeset as shown online using the same spacing and alignment while making accommodations for your specific text. Please note that due to variations in computer screen resolutions, the colors as you view them at home may vary from the finished product.

PROOF CHANGES
You will have the opportunity to make changes to your proof(s) before approving - instructions for doing so will be included in the email you receive with your first proof. After receiving your changes a revised proof for each piece will be sent to you at no additional charge. Any changes beyond this second complimentary proof will result in additional proof fees of $20 each. Proofreading Please proofread carefully. Paper Source is not responsible for errors. We require all proofs to be approved (signed & dated) by you before printing begins.

TURNAROUND TIME
Once we receive the approved proof(s) from you printing will be scheduled. Your order will ship after printing is completed in approximately 3-5 business days. *Please note: The timeline does not include proof time or time in transit. Business days do not include weekends or holidays. SAMPLES All AVENUE ANNE cards may be used as samples on our website or printed and promotional material. If you do not wish to have your order used as a sample, please let us know.

RETURN ADDRESS PRINTING
Although return address printing is not available for order through our website, you can add return address printing service to your order. Return address printing can be done on any envelope size. Please call 412.781.5773 for more information on available options and return address printing pricing.

REORDERS
We are happy to help you purchase additional quantities of your order; please contact us at 412-781-5773 to speak with Barb or Anne. If revisions to your text are necessary after your order is place and being, printed, shipped or delivered, you must reorder to correct the error. We extend a 20% discount under these circumstances and provide a complimentary electronic proof. If you approve a proof with errors and must reorder, we will extend the same 20% discount and provide a complimentary electronic proof. You will still be charged for the original order. Reorders must be placed within 30 days to receive a discount and complimentary proof. After 30 days, your files are deleted and a new order must be placed.

REPRINTS AND REFUNDS
If you choose to proceed with a photo that our designers have advised against using because of quality issues and you are unhappy with the final results, you will not receive a refund. If you are unhappy with your products, please contact us within 30 days to discuss terms of our refunds, less customization, shipping, cancellation and/or rush fees. SHIPPING POLICY Our shipping policy and processing rates cover the expenses we incur in processing your order, packing the purchased item(s), transportation and related overhead. Most orders are processed and shipped within 1 to 2 business days after your order is submitted, not including custom orders. Orders with priority shipping will be processed on the same day if received by 1pm CST (excludes weekends and holidays). Priority shipping options for custom orders applies to transit time only. Production time cannot be expedited. Once your package leaves our warehouse, you can expect the following transit times for delivery within the continental US (barring extreme weather conditions and holidays): Ground - 5 to 10 business days depending on your ship-to address. 2 Day - placed by 1pm CST (Monday through Friday) will be delivered in 2 business days. Next Day - placed by 1pm CST (Monday through Friday) will be delivered in 1 business day. Saturday delivery can be arranged for Next Day orders shipping out on Friday by contacting Customer Service via phone after placing your order. There will be a $12 upgrade fee applied to your order for this service. Your request must be received and confirmed by 1pm CST. You will receive an email the day your order is shipped which will include tracking information. We guarantee packages are put on board the shipping transit service. However, from this point, we do not take responsibility for the delivery of the shipment to you. Residential deliveries that do not require signature may be left in a safe place, out of sight and out of weather at the driver's discretion. This could include the front door, side porch, back porch and garage area. Gift cards are shipped at no charge provided rush delivery is not required. Signature may be required for delivery of custom orders. Please take this into consideration when selecting a ship-to address for your package. For residential deliveries that require signature, you can leave instructions for the driver if no one will be home. For example, you can ask that it be delivered to a neighbor who will be home. Orders shipping to PO Boxes, APO/FPO addresses and rural areas will be sent via the United States Postal Service. Orders shipped to Canada ship via UPS and are subject to customs, duties and brokerage fees. The customer is responsible for paying these fees. Customer service is not responsible for estimating country specific customs fees. International orders excluding Canada are calculated per shipping address. Recipients are responsible for all applicable customs duties and taxes. Back ordered items - We will ship back ordered items when available. You will incur no additional shipping charges for the separate shipment of back ordered items. Please see our back order policy for further details.

MATERIALS SUBMITTED BY CUSTOMER
You will retain ownership of such user submitted materials, and you grant AVENUE ANNE transferable, royalty-free, right and license to use, reproduce, distribute, redesign and publicly display your materials. You hereby warrant that you own and otherwise possess all necessary rights with respect to the submitted materials; that your submitted materials do not and will not infringe, misappropriate, use or disclose without authorization, or otherwise violate any copyright, trade secret right or other intellectual property or property right of any third party; that the submitted materials are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable; and that you have the right to grant the licenses to AVENUE ANNE. You agree to defend and hold AVENUE ANNE it's partners, employees and agents and 3rd party users hairless from and against any and all claims, liabilities, causes of action, damages, losses and expenses including legal fees that arise directly or indirectly from your breach of these terms and your activities in connection with obtaining any products or services from AVENUE ANNE. AVENUE ANNE reserves the right to refuse to print any materials submitted for any reason.

COPYRIGHT POLICY
AVENUE ANNE, in accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA") (the text of which may be found on the U.S. Copyright Office website at http://lcweb.loc.gov/copyright/), responds to notices of any actual or alleged infringement. AVENUE ANNE and its licensors own all right, title and interest, including all worldwide intellectual property rights in the Site and all content thereon other than User Supplied Material (described below) and the copyrights, images, trademarks, and logos contained therein and all intellectual property rights associated therewith.. You agree you will not remove, alter or conceal any copyright, trademark, or other proprietary rights notices incorporated in or accompanying the Site or related products and services. You agree not to circumvent, disable or otherwise interfere with security related features that prevent or restrict use or copying of the Site or use, reproduce, modify, adapt, prepare derivative works based on, reverse-engineer, perform, display, publish, distribute, transmit, broadcast, sell, license or otherwise exploit the Site or any part thereof without the prior written permission of AVENUE ANNE. AVENUE ANNE products may not be resold without an authorized reseller agreement in place. This includes auction sites & blogs. Use of a Product in a manner not specifically authorized by this Agreement constitutes an infringement of our licensors' proprietary rights and will subject you to infringement damages of no less than $100,000. Use of a Product in a manner that is contrary to a restriction stated in this Agreement is prohibited. In addition, you may not post any Product(s) or portion thereof or derived works to newsgroups, mail lists or electronic bulletin boards in a downloadable format. AVENUE ANNE and its licensors own and will retain all copyrights in and to any Product. You may not copy, modify, sublicense, sell, distribute or transfer any part of any Product except as provided in this Agreement, and you agree to prevent unauthorized copying of the Product. Unauthorized reproduction, modification, sale or distribution is subject to civil and criminal penalties. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, NEITHER AVENUE ANNE NOR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, DISTRIBUTORS OR PARTNERS SHALL BE LIABLE TO YOU FOR ANY DAMAGES WHATSOEVER, INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, RESULTING, ARISING OUT OF OR IN CONNECTION WITH THE SITE (INCLUDING, WITHOUT LIMITATION, SUCH DAMAGES INCURRED BY THIRD PARTIES, DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS OR LOSS OF DATA), UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY, AND WHETHER OR NOT THE DAMAGES ARE FORESEEABLE AND WHETHER OR NOT AVENUE ANNE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE SHALL BE TO STOP USING THE SITE.

INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AVENUE ANNE, its officers, directors, shareholders, employees, agents, representatives, affiliates, partners and distributors from and against any and all claims, liabilities, causes of action, damages, losses, and expenses, including, without limitation, reasonable legal and expert fees, arising out of or in any way connected with your access to or use of the Site, any actions or activities in connection with the Site, any actions or activities in connection with your account, your violation of these Terms, or the violation of any other terms and conditions of any other agreements or terms to which you are bound with AVENUE ANNE. You agree that AVENUE ANNE may at any time, and without notice, suspend or terminate your access to the Site if you fail to comply with the Terms or applicable law. We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate. We strive to present the most recent, most accurate, and most reliable information on our Web site at all times. However, there may be occasions when some of the information featured on www.AVENUEANNE.com may contain incomplete data, typographical errors, or inaccuracies. Any errors are wholly unintentional and we apologize if erroneous information is reflected in merchandise price or item availability, or in any way affects your individual order. But please be aware that we present our content 'as is' and make no claims to its accuracy, either expressed or implied. We reserve the right to amend errors or to update product information at any time without prior notice. In the event an AVENUE ANNE product is listed at an incorrect price due to photographical error, typographical error or error in pricing information received from our suppliers, AVENUE ANNE shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. AVENUE ANNE shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, AVENUE ANNE shall issue a credit to your credit card account in the amount of the incorrect price. At www.AVENUEANNE.com, we go out of our way to select the kind of distinctive merchandise for which the AVENUE ANNE name is recognized. Please understand that many of our featured items are selected in limited quantities and, because of their limited availability, their stock will not and cannot be refreshed. That means once an item is gone, it may be gone for good and not appear on the Web site again. When an item featured on www.AVENUEANNE.com is no longer in stock, we make every attempt to remove that item from the Web site in a timely manner. If there are items on your order that are not immediately available to ship to you, we will back order the out of stock item(s) and ship the rest of your order right away. We will contact you via email to inform you that one or more items have been back ordered and to provide you with an estimated restock date. Should you have any questions concerning the availability of a particular item, please contact us. We are also happy to assist you in finding alternative options for out of stock items.

GENERAL TERMS
These Terms constitute the entire agreement between AVENUE ANNE and you with respect to your use of the Site and supersede any prior or contemporaneous agreements or understandings. These Terms may be modified from time to time by AVENUE ANNE, and any use by you of the Site following such modification shall be deemed your acceptance thereof. AVENUE ANNE failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court finds that one or more provisions contained in these Terms is invalid, you agree that the remainder of the Terms shall be enforceable. AVENUE ANNE shall have the right to assign its rights and/or delegate its obligations under these Terms, in whole or in part, without restriction. These Terms shall be governed by and construed in accordance with the laws of the State of Pensylvania, without regard to conflicts of laws principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts of the State of Pennsylvania.
